The problem is if the law is properly followed their Trademark request wouldn't be accepted because of per-existence and it being a common word but with how things have gone in the past (Windows) I wouldn't be surprised about them getting the Trademark.

That's not quite how trademarks work. You can trademark almost anything. There are a lot of companies that have trademarks on numbers for instance. IBM bought the trademark for "400" from Atari in the 80s for instance and Boeing owns the trademarks on 737, 747, and etc.

Those are not exactly common since they are specific numbers and since there wern't pre-existing things within their specific industries with those numbers it would be alright to Trademark them. I did forget to mention that pre-existence would be of something similar. In the case of "scrolls" there games that already use that word and so shouldn't be able to be Trademarked. The word "Windows" should never have been given to Microsoft because it is a common word for the kind of OS environment that is used in Windows, Linux, Mac, ect. and existed long before the Microsoft Windows OS existed.
