You sure the legal firm wasn't Dewey, Cheatham, and Howe?
The problem is if the law is properly followed their Trademark request wouldn't be accepted because of per-existence and it being a common word but with how things have gone in the past (Windows) I wouldn't be surprised about them getting the Trademark.

That's not quite how trademarks work. You can trademark almost anything. There are a lot of companies that have trademarks on numbers for instance. IBM bought the trademark for "400" from Atari in the 80s for instance and Boeing owns the trademarks on 737, 747, and etc.
