Fallout MMO lawsuit still ongoing???

Last I read Beth was in a lawsuit with Interplay regarding the rights to develop a Fallout MMO. Have any of you guys heard any recent news as to whether this has been settled or if this project will move forward?

The project has no signs of being closed down, and it's even been teased via e-mails and the website.

Not sure about the lawsuit, however.
